This SMS Terms & Conditions and Privacy Notice (“SMS Terms”) explains how The Lighthouse | Black Girl Projects (“TL|BGP,” “we,” “us,” or “our”) operates its text messaging programs and how we collect, use, and protect information in connection with those programs. By enrolling in, opting into, or otherwise participating in any TL|BGP SMS/text messaging program (the “Program”), you agree to these SMS Terms, as well as our Website Terms of Use and general Privacy Policy, which are incorporated by reference.
If you do not agree, do not opt in to or use the Program.
1) Program Description
TL|BGP may send recurring SMS or MMS messages for:
Marketing and promotions
Event notifications and reminders
Fundraising updates and donation opportunities
Community news and organizational updates
Message frequency varies by Program and user engagement.
2) Opt-In and Consent
Single opt-in: You will receive messages after you provide your mobile number and take an action that clearly indicates your consent (for example, submitting a form on our website, texting a keyword to a short code or long code, checking an opt-in box at an event, or otherwise affirmatively agreeing to receive texts).
Your consent to receive messages is not a condition of any purchase or donation.
By opting in, you represent that you are the owner or customary user of the mobile number provided and that you have the authority to consent to receive messages at that number.
3) Opt-Out and Help
You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. After opting out, you may receive a final message confirming your opt-out.

4) Message and Data Rates
Message and data rates may apply from your mobile carrier. Message frequency varies. We do not charge you for the Program, but your carrier’s rates may apply.
Not all mobile devices or carriers are supported. Delivery of messages is subject to effective transmission by your carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages.
5) Eligibility and Accounts
The Program is intended for individuals 18 years of age or older. If you are between 13 and 17, you may participate only with the consent and supervision of a parent or legal guardian.
The Program is not directed to children under 13, and we do not knowingly collect personal information via SMS from children under 13. If we learn we have collected such information, we will delete it.

Names
Message content (including your replies and any information you send to us by SMS/MMS)
7) How We Use SMS Information
We use the information collected through the Program to:
Send marketing and promotional messages
Provide event notifications and reminders

Operate, maintain, secure, and improve the Program
Respond to your requests, questions, or feedback
Comply with law, protect our rights, and prevent fraud or misuse
8) Sharing and Disclosure
We do not sell or share your SMS-related information with third parties for their own marketing purposes.
We may disclose information to:
Our service providers (e.g., messaging platforms, data hosting, security vendors) who process information on our behalf under contractual obligations of confidentiality and appropriate safeguards
Comply with legal obligations, law enforcement requests, or to protect our rights, users, or the public in connection with organizational changes (e.g., merger, reorganization), subject to applicable law
9) Data Retention
We retain SMS-related information for as long as needed to fulfill the purposes described in these SMS Terms, comply with our legal obligations, resolve disputes, and enforce our agreements. If you opt out, we may retain your number on a suppression list to honor your opt-out.
10) Your Choices and Rights
Opt-out: You can opt out at any time by following the instructions in Section 3. Update your information: You may request to update or correct your contact details by contacting us at privacy@loveblackgirls.org.
Do not send sensitive data: Please do not send confidential, financial, health, or other sensitive information by SMS. If we receive such information inadvertently, we will handle it consistent with these SMS Terms but may delete it for your protection.
11) Security
We employ reasonable administrative, technical, and physical safeguards designed to protect SMS-related information. However, no system can be guaranteed 100% secure, and SMS is not a fully secure communication channel. Please use caution when sending information by text.
12) User Responsibilities
Keep your contact information up to date and notify us of changes to your mobile number. If you relinquish your number, you agree to opt out before doing so.
Do not use the Program to send unlawful, harmful, or abusive content, or to infringe others’ rights.
13) Program Changes, Suspension, or Termination
We may modify, suspend, or discontinue the Program or any part of it at any time without notice. We may update these SMS Terms from time to time—see “Changes to This Notice” below.
14) Disclaimers and Limitation of Liability
The Program is provided “as is” and “as available.” We make no warranties or representations regarding availability, timeliness, security, or reliability of SMS/MMS delivery. To the maximum extent permitted by law, TL|BGP and its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program or these SMS Terms. Some jurisdictions do not allow certain limitations; in such cases, those limitations apply to the fullest extent permitted by law.
15) Indemnification
You agree to indemnify, defend, and hold harmless TL|BGP and its officers, directors, employees, volunteers, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your participation in the Program, your violation of these SMS Terms, or your misuse of the Program.
16) Minors and Sensitive Information
We do not knowingly collect SMS information from children under 13. If you believe a child under 13 has provided personal information via SMS, please contact us so we can take appropriate action.
Participants aged 13–17 must have parental or guardian consent to participate, and participation should occur under their supervision.
Please do not send sensitive personal information by SMS (e.g., Social Security numbers, financial account numbers, medical information, racial or ethnic origin, religious beliefs, or precise geolocation).
17) Mississippi Governing Law; Venue
These SMS Terms and your participation in the Program are governed by the laws of the State of Mississippi, without regard to its conflict-of-law rules.
You agree that any action or proceeding arising out of or relating to the Program or these SMS Terms will be brought exclusively in the state or federal courts located in Mississippi, and you consent to the personal jurisdiction of such courts.
18) Changes to This Notice
We may update these SMS Terms from time to time. The “Effective Date” at the top indicates when these SMS Terms were last revised. Your continued participation in the Program after an update constitutes acceptance of the updated terms.

These Website Terms and Conditions (“Terms”) govern your access to and use of the websites and online services operated by The Lighthouse | Black Girl Projects (“TL|BGP,” “we,” “us,” or “our”), including any content, functionality, donations, event registrations, and e-commerce offerings available through them (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Who We Are
The Site is owned and operated by The Lighthouse | Black Girl Projects, a nonprofit organization headquartered in Jackson, Mississippi.
2. Eligibility
You must be at least 13 years old to use the Site. If you are 13 to 17, you may use the Site only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. Permitted Use; Prohibited Conduct

The Site does not require or provide user accounts or profiles. Where the Site enables you to enter information (e.g., to register for events, donate, or purchase items), you must provide accurate and complete information.
5. Donations, Event Registrations, and E-Commerce
Donations, event registrations, and purchases made through the Site may be processed by third-party providers such as GiveButter, GoFundMe Pro, and other payment platforms (collectively, “Payment Providers”). We do not control and are not responsible for the content, terms, or privacy practices of Payment Providers. Your interactions with them are governed by their terms and policies.

6. Third-Party Services and Links
The Site may integrate or link to third-party services and content (including GiveButter, GoFundMe Pro, Wix Analytics, and Constant Contact). We do not endorse or control third-party services and are not responsible for their availability, content, terms, or practices. Your use of third-party services is at your own risk and is governed by their terms and policies.
7. Intellectual Property
The Site and all content, features, and functionality (including text, graphics, logos, images, audio, video, and the design, selection, and arrangement thereof) are owned by TL|BGP or its licensors and are protected by U.S. and international intellectual property laws. You may view the Site for personal, noncommercial use only. Except as expressly permitted by law, you may not copy, reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent.
8. User Submissions and Feedback
If you submit comments, suggestions, ideas, or other materials (“Feedback”) to us, you grant TL|BGP a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback in any media. You represent that your Feedback does not infringe any third-party rights.
9. Privacy
Your use of the Site is subject to our General Privacy Policy, which is incorporated into these Terms by reference. Our SMS Terms & Conditions and Privacy Notice governs our text messaging programs separately. Please review both policies carefully.
10. Disclaimer of Warranties
The Site, and all information, services, and content provided through it, are provided “as is” and “as available” without warranties of any kind, express or implied. Without limiting the foregoing, we do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by law, TL|BGP and its officers, directors, employees, volunteers, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of or inability to use the Site. In no event will our total liability to you for all claims relating to the Site exceed one hundred U.S. dollars ($100).
12. Indemnification

These Terms and your use of the Site are governed by the laws of the State of Mississippi, without regard to its conflicts of law principles. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Mississippi, and you consent to the personal jurisdiction of such courts.
15. Severability; Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision does not waive our right to enforce it later.

This General Privacy Policy (“Policy”) describes how The Lighthouse | Black Girl Projects (“TL|BGP,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit or interact with our websites and online services (collectively, the “Site”). This Policy does not apply to our SMS/text messaging programs, which are governed by our separate SMS Terms & Conditions and Privacy Notice.
By using the Site, you agree to the practices described in this Policy.

We collect the following categories of personal information when you interact with the Site or our online forms:
Identifiers and contact information: name and phone number.
Communications: message content you send to us through Site forms or communications tools.
Note: We do not request or intentionally collect additional categories of personal information through the Site (such as email addresses, payment information, demographic data, or user-generated content) unless you voluntarily provide such information in your communications with us. Payment information for donations, event registrations, or purchases is collected directly by third-party providers (see Section 4) and is not stored by TL|BGP.
